1. Introduction
Welcome to Blue Bay Curaçao Golf & Beach Resort. We are pleased that you have chosen our resort. These Terms & Conditions have been drafted to provide you with clarity and certainty, and to protect both our resort and our guests. We strive to create a welcoming and carefree experience, while also ensuring clear agreements.
By making a reservation with Blue Bay Hotel B.V., you agree to these Terms & Conditions.
2. Definitions

Accommodation: any hotel room, villa, or apartment rented out by Blue Bay Hotel B.V.

Guest: the main booker and all fellow travelers staying in the Accommodation.

Booking: a confirmed reservation with a unique reservation number.

Resort: all facilities of Blue Bay Curaçao Golf & Beach Resort, including the beach, golf course, swimming pools, restaurants, bars, and other amenities.
3. Reservations, Prices & Payments
All prices are in USD unless otherwise stated, and include applicable taxes and mandatory fees.
Blue Bay reserves the right to change prices, facilities, and conditions at any time. Only a booking confirmed by Blue Bay is binding.
Obvious errors or mistakes in rates or offers are not binding and may be corrected by Blue Bay, even after confirmation.
Payment terms vary by rate type and are displayed prior to completing the booking. Some rates require a deposit or full prepayment.
At check-in, a deposit of at least USD 250 per accommodation may be required via credit card authorization. This covers damages, extra cleaning, outstanding charges, or penalties.
By booking, guests authorize Blue Bay to charge any outstanding amounts or additional costs directly to their credit card.
4. Cancellations, Changes & No-Shows
Cancellation policies vary by rate type and are always displayed prior to confirmation.
For Non-Refundable rates, no refund or changes are ever possible.
For Flexible rates, cancellations or rebookings are only possible up to 1 month before arrival. After that, no changes are allowed.
No-shows and early departures will always be charged in full for the booked stay.
No exceptions are made. We strongly recommend that all guests take out appropriate travel and cancellation insurance.
5. Check-in, Check-out & Occupancy

Check-in: from 3:00 PM (Blue Bay reserves the right to delay this in exceptional cases).

Check-out: no later than 11:00 AM.
Failure to check out on time will result in a charge of at least USD 250, depending on the accommodation category and any damage or lost revenue caused.
Only registered guests are permitted to stay overnight. The maximum occupancy per accommodation must not be exceeded.
Additional costs for early check-in, late check-out, or other extra services will be charged according to the price list available at reception.
6. House Rules & Conduct
The house rules are always available via our website and apply in full to all guests.
Blue Bay aims to provide a peaceful, safe, and welcoming environment. Parties, loud music, excessive noise, and disruptive behavior are prohibited.
Commercial activities, gatherings, or photoshoots are not allowed without prior written permission.
The use of illegal substances, hazardous materials, or weapons is strictly prohibited.
Guests are fully responsible for their own behavior and that of their party. Violations of house rules may result in immediate termination of the stay without refund, and all resulting costs may be charged.
7. Pets, Smoking & Damage
Pets are only allowed if this has been agreed upon in writing beforehand. Violations will result in a cleaning fee of at least USD 500, in addition to any damages.
Smoking and vaping are prohibited in all accommodations. Violations will result in cleaning and restoration charges.
Guests are liable for all damage, loss, or excessive cleaning. If an accommodation cannot be rented out due to such issues, lost revenue will also be charged.
8. Facilities & Inclusions
Use of resort facilities, including swimming pools (also those belonging to villas or apartments), is at the guest’s own risk.
Blue Bay may temporarily close facilities for maintenance, safety, or weather conditions, without refund.
Activities or services offered by external partners (such as diving, excursions, spa, or golf packages) are subject to their own terms.
9. Maintenance & Construction
Blue Bay is a dynamic resort that is continuously developing. Maintenance and construction work may cause noise, dust, limited access, or temporary closures.
Pricing already takes potential inconvenience into account. Therefore, no additional compensation will be provided.
10. Safety & Compliance
Always follow staff instructions and safety guidelines at beaches, pools, golf course, and sports facilities.
Children must be supervised by an adult at all times.
Use of facilities is entirely at the guest’s own risk. Blue Bay accepts no liability for accidents, injuries, or damages.
The use of drones, fireworks, weapons, or hazardous objects is only allowed with prior written permission.
Our security staff has the right to take appropriate measures to ensure safety and peace within the resort.
11. Liability
Blue Bay accepts no liability for loss, theft, or damage to personal belongings, even if handed in for safekeeping.
The total liability of Blue Bay is in all cases limited to the amount paid for the relevant reservation.
Blue Bay is never liable for indirect damages, consequential damages, loss of profit, or intangible damages.
12. Allocation & Change of Accommodation Category
Blue Bay reserves the right to assign guests to a different accommodation category upon arrival or prior to the stay if the booked category is unavailable.
In case of an upgrade, a surcharge may apply, or it may be offered free of charge as a service, depending on the situation.
In case of a downgrade, the price difference will be determined by Blue Bay based on the applicable rates at that time, and a refund may be issued.
If Blue Bay offers an alternative accommodation for operational reasons, guests will be informed, even if this happens last-minute.
13. Chargebacks & Acceptance of Stay
By completing check-in, the guest confirms that the accommodation has been accepted and meets expectations.
From check-in onwards, any right to chargebacks or refunds on the grounds of “product unacceptable” or similar reasons is void.
Complaints must be reported directly to reception. Blue Bay always reserves the right to resolve complaints during the stay.
Blue Bay will legally contest any unjustified chargeback in full. All related costs may be charged to the guest.
14. Force Majeure
Blue Bay is not responsible for shortcomings caused by circumstances beyond its reasonable control, including natural disasters, pandemics, government measures, utility disruptions, strikes, or construction work outside the resort.
In such cases, refunds are excluded. Blue Bay may, as a courtesy, offer a voucher or rebooking, but is not obliged to do so.
15. Complaints & Service
If something is not to your satisfaction, please report it immediately to reception during your stay. This allows us to resolve it quickly. Complaints submitted afterward cannot be processed.
16. Privacy
Blue Bay processes personal data in accordance with its Privacy Policy, available via our website or at reception.
17. Applicability & Precedence
These Terms & Conditions apply to all reservations, regardless of whether they are made directly or via third parties.
If third parties apply different conditions, these Terms apply in addition and take precedence where they are stricter.
18. Governing Law & Jurisdiction
These Terms are governed exclusively by the laws of Curaçao.
Disputes will be submitted exclusively to the competent court in Curaçao, unless mandatory law provides otherwise.
