1. Introduction

Welcome to Blue Bay Curaçao Golf & Beach Resort. These Terms & Conditions have been drafted to give you clarity and certainty, and to protect both our guests and our resort. By making a reservation with Blue Bay Hotel B.V. you agree to these Terms & Conditions, to our House Rules (Part II) and to our Cancellation & Payment Policy (Part III).

2. Definitions

  • Accommodation: any hotel room, villa or apartment rented out by Blue Bay Hotel B.V.
  • Guest: the main booker and all fellow travellers staying in the Accommodation.
  • Booking: a confirmed reservation with a unique reservation number.
  • Resort: all facilities of Blue Bay Curaçao Golf & Beach Resort, including the beach, golf course, swimming pools, restaurants, bars and other amenities.

3. Rates, Taxes and Fees

  • All rates are quoted in USD unless stated otherwise.
  • A resort fee of USD 10 per accommodation per night applies to every stay.
  • A tax of 7% is charged on the total amount, including the resort fee.
  • The room rate, the resort fee and the tax are shown separately in the rate breakdown before you confirm your booking. No other mandatory charges apply.
  • Charges for optional extras and services are set out in Annex A and in the price list available at Reception.
  • Blue Bay may change rates, facilities and conditions at any time for new bookings. Confirmed bookings are not affected, except where a change is required by law or by government measures.
  • Obvious errors in rates or offers are not binding and may be corrected by Blue Bay, also after confirmation. Where a booking has already been confirmed at an incorrect rate, Blue Bay may either honour the booking or cancel it against a full refund of amounts paid.
  • Only a booking confirmed by Blue Bay is binding.
  • By booking, you authorise Blue Bay to charge outstanding amounts and additional costs to the credit card on file.

4. Payment and Deposit

  • Payment terms depend on the rate you book and are shown before you confirm your booking. Some rates require a deposit; others require payment in full at the time of booking.
  • Payment must in all cases be completed on arrival before the keys are issued.
  • The credit card used must be in the name of the main booker and is verified by the Front Desk at check-in.
  • At check-in a deposit of USD 250 per accommodation is placed as a credit card authorisation. It covers incidentals, damage, additional cleaning, outstanding charges and penalties.
  • If the deposit is not used, the authorisation is released within one week of departure. The moment the amount becomes available again depends on your own bank or card issuer.

5. Cancellations, Changes and No-Shows

  • Cancellation and change conditions depend on the rate you book and are always shown before you confirm. The full policy is set out in Part III.
  • For Non-Refundable and special rates, no refund or change is possible.
  • No-shows and early departures are charged in full for the booked stay.
  • For bookings of three or more accommodations, and for events, weddings and long-stay reservations, separate terms apply (see article 6).
  • Blue Bay may offer a goodwill solution at its own discretion. Doing so does not create any right in other or future cases.
  • We strongly recommend that all guests take out appropriate travel and cancellation insurance.

6. Groups, Events and Long Stays

  • For bookings of three or more accommodations, payment and cancellation terms are agreed separately and confirmed in writing. These may differ from the standard 14-day term.
  • Events, weddings and other special occasions are arranged by quotation, with their own terms, payment schedule and cancellation conditions.
  • Long-stay reservations are agreed separately and confirmed in writing.
  • Where such separate terms have been agreed in writing, they prevail over Part III for that booking.

7. Check-in, Check-out and Occupancy

  • Check-in is from 3:00 PM. Blue Bay may delay this in exceptional cases.
  • Check-out is no later than 11:00 AM. If a late check-out has not been requested and granted, one room night will be charged.
  • Late check-out must be requested at Reception one day before departure, cannot be guaranteed and is subject to a surcharge (Annex A).
  • Only registered guests may stay overnight. The maximum occupancy of the accommodation must not be exceeded; children count towards this maximum.
  • All guests must be registered with valid identification: a sedula, or a passport for foreign guests. The minimum age to check in is 18.
  • Charges for early check-in, late check-out and other extra services are set out in Annex A.

8. House Rules and Conduct

  • Our House Rules (Part II) apply in full to all guests and form part of these Terms & Conditions.
  • Parties, loud music, excessive noise and disruptive behaviour are prohibited.
  • Commercial activities, gatherings and photo or video shoots require prior written permission.
  • The use of illegal substances, hazardous materials and weapons is strictly prohibited.
  • Guests are fully responsible for their own conduct and that of their party, including visitors they receive.
  • In the event of a first, minor breach we will issue a warning. In the event of a serious breach, or a repeated breach after a warning, Blue Bay may terminate the stay immediately without refund and charge all resulting costs.

9. Pets, Smoking and Damage

  • Pets are not permitted on the premises or in the accommodations. A cleaning fee of USD 500 applies if this rule is not observed, in addition to any damage caused.
  • Certified assistance and service dogs are welcome. Please inform us before arrival so we can prepare your accommodation.
  • Smoking and vaping are not permitted inside the accommodations. They are permitted on your own balcony or terrace and in the designated areas. Smoking inside an accommodation incurs a deep-cleaning fee of USD 500, in addition to any damage caused.
  • Guests are liable for all damage, loss and excessive cleaning. If an accommodation cannot be rented out as a result, the lost revenue will also be charged.

10. Facilities and Inclusions

  • Use of the resort facilities, including swimming pools — also those belonging to villas or apartments — is at the guest’s own risk.
  • Blue Bay may temporarily close facilities for maintenance, safety or weather conditions. This does not give rise to a refund.
  • Activities and services provided by external partners, such as diving, excursions, spa treatments and golf packages, are subject to their own terms.

11. Ownership and Differences between Accommodations

  • The accommodations at Blue Bay are individually owned. Furnishing, finish and equipment may therefore differ between accommodations within the same category.
  • Photographs on our website and on booking platforms are representative of the category, not of one specific accommodation.

12. Maintenance, Construction and Utilities

  • Blue Bay is a resort that is continuously developing. Maintenance and construction work may cause noise, dust, limited access or temporary closures. Our rates already take this into account, and no additional compensation is provided.
  • This does not apply where the works make normal use of the accommodation impossible. In that case we will offer a suitable alternative.
  • Interruptions to electricity, water and internet may occur on Curaçao and are outside our control. Several restaurants on the resort are equipped with generators, and charging points for essential equipment are available on the resort. Such interruptions do not give rise to a refund.

13. Safety and Compliance

  • Always follow the instructions of our staff and the safety guidelines at the beach, the pools, the golf course and the sports facilities.
  • Children must be supervised by an adult at all times.
  • Use of the facilities is entirely at the guest’s own risk.
  • The use of drones, fireworks, weapons and hazardous objects requires prior written permission.
  • Our security staff may take appropriate measures to safeguard safety and peace within the resort.

14. Liability

  • Every accommodation is equipped with an electronic safe. Guests are required to keep money, jewellery, electronics, travel documents and other valuables in the safe when not in use.
  • Blue Bay accepts no liability for loss, theft or damage to personal belongings left in the accommodation or elsewhere on the resort.
  • This exclusion does not apply in the event of intent or gross negligence on the part of Blue Bay, nor to items formally deposited with Reception for safekeeping against a receipt.
  • Blue Bay’s total liability is in all cases limited to the amount paid for the relevant reservation.
  • Blue Bay is never liable for indirect or consequential damage, loss of profit or intangible damage.

15. Allocation and Change of Accommodation Category

  • Blue Bay may assign a guest to a different accommodation category, before or upon arrival, if the booked category is unavailable.
  • In the case of an upgrade, a surcharge may apply or the upgrade may be offered free of charge as a service.
  • In the case of a downgrade, the guest is refunded the difference between the rate paid and the rate applicable to the assigned category for the same dates.
  • Where Blue Bay offers an alternative accommodation for operational reasons, the guest will be informed, even if this happens at short notice.

16. Complaints, Refunds and Chargebacks

  • Any complaint or defect must be reported to Reception during your stay and as soon as it is noticed, so that we have a fair opportunity to resolve it.
  • Blue Bay always reserves the right to resolve a complaint during the stay.
  • If a matter is not reported during the stay, we may no longer be able to address it afterwards, and it cannot serve as grounds for a refund.
  • Blue Bay will contest any unjustified chargeback in full, and all related costs may be charged to the guest.

17. Force Majeure

  • Blue Bay is not responsible for shortcomings caused by circumstances beyond its reasonable control, including natural disasters, pandemics, government measures, utility disruptions, strikes and construction work outside the resort.
  • Where Blue Bay is unable to provide the booked accommodation as a result, amounts paid will be refunded less any costs already unavoidably incurred, or a voucher of equivalent value will be offered.

18. Privacy, Registration and Camera Surveillance

  • Blue Bay processes personal data in accordance with its Privacy Policy, available on our website and at Reception.
  • At check-in we record the details required for guest registration: name, date of birth, nationality, address, and the type and number of the identification document presented. These details are kept for as long as required for our administration and legal obligations, and are not used for any other purpose without your consent.
  • Camera surveillance is in operation in the public areas of the resort for the safety of guests, staff and property. Recordings are retained for a limited period and are only viewed in the event of an incident or at the request of the competent authorities. Cameras are not installed in accommodations or in other private areas.

19. Applicability and Precedence

  • These Terms & Conditions apply to all reservations, whether made directly or through a third party.
  • Where a booking is made through a third party such as an online travel agency, the conditions of that party apply to the booking. These Terms & Conditions apply in addition, in so far as they do not conflict with those conditions.
  • Where separate written terms have been agreed for a group, event or long-stay booking, those terms prevail.
  • These Terms & Conditions are published in English. If a translation is made available, the English version prevails in the event of any difference.

20. Governing Law and Jurisdiction

  • These Terms are governed by the laws of Curaçao.
  • Disputes will be submitted to the competent court in Curaçao, unless mandatory law provides otherwise.
